EGA Guitars Sell Your Gear & Trade-In Terms

These Sell Your Gear & Trade-In Terms (“Sell Your Gear Terms”) govern submissions, evaluations, proposed sales, and proposed trades of musical instruments and other property to EGA Guitars LLC (“EGA Guitars,” “EGA,” “we,” “us,” or “our”).

By submitting an item for evaluation, accepting a preliminary or final offer, shipping or delivering an item to EGA Guitars, or otherwise proceeding with a proposed sale or trade, you agree to these Sell Your Gear Terms and the EGA Guitars Terms of Service and Privacy Policy to the extent applicable.

1. Eligible Gear

EGA Guitars may evaluate and purchase eligible guitars, basses, amplifiers, pedals, effects, and other musical instruments or gear that EGA elects to consider.

Submission of an item does not guarantee that EGA Guitars will evaluate, purchase, accept, or make an offer for that item.

Accepted categories may change based on inventory, condition, demand, resale value, transportation requirements, legal or compliance considerations, or other reasonable business factors.

2. Eligibility to Sell or Trade

You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, and legally capable of entering into a binding transaction in order to sell or trade property to EGA Guitars.

By proceeding with a sale or trade, you represent that you have the legal capacity and authority to enter into the transaction and transfer lawful ownership of the submitted property.

3. Initial Submission

Customers may submit gear for evaluation through the EGA Guitars mobile application or another submission method provided by EGA Guitars.

A submission may require information such as:

  • Brand

  • Model

  • Item type

  • Condition

  • Photographs

  • Serial number

  • Modification or repair information

  • Included accessories

  • Included documentation

  • Requested value

  • Sell or trade preference

  • Contact information

  • Other reasonably relevant information

Mobile submissions generally require at least two photographs showing the front and back of the item.

EGA Guitars may request additional photographs, video, serial-number information, documentation, or other information before completing an evaluation.

4. Submission Does Not Create a Sale

Submitting gear does not obligate EGA Guitars to purchase it.

It also does not obligate the customer to sell or trade it.

No sale, trade, transfer of ownership, or other completed transaction occurs merely because EGA Guitars:

  • Reviews a submission

  • Discusses an item's value

  • Provides an estimate

  • Provides a preliminary quote or offer

  • Provides shipping instructions

  • Provides a shipping label

  • Receives the item

  • Begins inspecting the item

A transaction is completed only as described in these Sell Your Gear Terms.

5. Preliminary Offers

Any quote, estimate, valuation, or offer issued before EGA Guitars physically receives and inspects an item is a preliminary offer only.

Preliminary offers are based on information reasonably available at the time, including customer-provided photographs, descriptions, condition information, documentation, and market information.

Every preliminary offer remains subject to final physical inspection, verification, and acceptance by EGA Guitars.

6. How We Determine Value

EGA Guitars may consider factors including:

  • Current market conditions

  • Recent comparable sales

  • Historical sales information

  • Brand and model

  • Age

  • Condition

  • Originality

  • Modifications

  • Repairs

  • Cosmetic condition

  • Functionality

  • Included cases or accessories

  • Documentation

  • Market demand

  • Current EGA Guitars inventory

  • Expected resale value

  • Required repairs

  • Refurbishment costs

  • Setup or servicing costs

  • Shipping and handling considerations

  • Other reasonably relevant factors

EGA Guitars purchases merchandise for resale.

An EGA Guitars purchase or trade offer may therefore differ from retail asking prices, marketplace listings, private-sale values, appraisal values, replacement values, insurance values, or the amount a seller might obtain by selling directly to another individual.

7. Shipping Gear to EGA Guitars

After a preliminary offer has been discussed and the customer elects to proceed, EGA Guitars may provide shipping instructions or an available shipping-label option.

Do not ship gear to EGA Guitars unless EGA Guitars has authorized or instructed you to do so.

Applicable shipping arrangements and any material shipping charges, deductions, or responsibilities will be communicated before shipment where reasonably practicable.

Providing a shipping label or shipping instructions does not constitute final acceptance of the item or transfer ownership to EGA Guitars.

8. Packaging

The customer must package submitted property safely and appropriately for transportation.

Customers must follow reasonable packing instructions provided by EGA Guitars.

Gear should be immobilized within its carton and adequately protected against normal transportation hazards.

When a customer independently selects a carrier or shipping service, the customer is responsible for selecting appropriate tracking and insurance.

Failure to use reasonable packaging or follow material shipping instructions may affect responsibility for loss or damage occurring in transit.

9. Receipt and Physical Inspection

An in-hand inspection is required before EGA Guitars completes an acquisition.

Inspection may include evaluation of:

  • Cosmetic condition

  • Structural condition

  • Electronics

  • Hardware

  • Functionality

  • Playability

  • Serial number

  • Authenticity

  • Originality

  • Modifications

  • Previous repairs

  • Replacement components

  • Missing components

  • Included accessories

  • Undisclosed damage

  • Moisture or environmental damage

  • Shipping damage

  • Other reasonably relevant characteristics

Where environmental conditions warrant, EGA Guitars may allow an instrument to acclimate before opening, handling, testing, or inspecting it.

Receipt of an item does not mean EGA Guitars has accepted the item for purchase or trade.

10. Final Offer

After physical inspection, EGA Guitars may:

  • Confirm the preliminary offer

  • Increase the offer

  • Reduce the offer

  • Request additional information

  • Decline the item

  • Propose another transaction structure

The final offer may differ from the preliminary offer when inspection reveals information that was not reasonably apparent from the original submission or when other relevant information materially affects the item's value or eligibility.

11. Revised Offers

If the final offer differs from the preliminary offer, EGA Guitars will communicate the revised offer to the seller.

The seller may accept or decline the revised offer.

Shipping an item to EGA Guitars does not, by itself, transfer ownership of that item to EGA Guitars.

A sale or trade is completed only after:

  • Physical inspection is completed;

  • A final offer is established;

  • The seller accepts the final offer;

  • Required seller verification is completed;

  • Material ownership, authenticity, fraud, or transaction concerns are reasonably resolved; and

  • EGA Guitars confirms completion of the transaction.

12. Transfer of Ownership

Unless otherwise agreed in writing, ownership of submitted property remains with the seller until the transaction has been finalized under these Sell Your Gear Terms.

Upon final acceptance of the transaction by EGA Guitars and issuance or authorization of the agreed payment or trade credit, the seller transfers to EGA Guitars all right, title, and interest in the property being sold or traded.

After ownership has transferred, EGA Guitars may inspect, service, repair, refurbish, photograph, market, list, resell, or otherwise handle the property as its own inventory, subject to applicable law.

13. Seller Withdrawal and Declined Offers

Before a transaction is finalized, a seller may decline a revised offer or otherwise choose not to complete the transaction.

If EGA Guitars changes or declines a preliminary offer after inspection and the seller does not wish to proceed, EGA Guitars will arrange for return of the item.

Unless otherwise disclosed before shipment, EGA Guitars will bear the reasonable cost of return shipping when the seller accurately represented the item and followed EGA Guitars' shipping instructions.

If the seller elects not to proceed even though EGA Guitars confirms the originally agreed preliminary offer, the seller may be responsible for reasonable return-shipping costs.

EGA Guitars may also require the seller to pay or reimburse reasonable return-shipping or related costs when:

  • The item was materially misrepresented

  • Significant damage was not disclosed

  • Material modifications were not disclosed

  • Important components are missing

  • A different item was shipped

  • The item is counterfeit or materially misidentified

  • The seller lacked authority to transfer it

  • An unauthorized shipment was made

  • Fraud or attempted fraud is reasonably suspected

  • Another material violation of these Sell Your Gear Terms occurred

EGA Guitars will not return property to a person if EGA Guitars is legally prohibited from doing so.

14. Seller Verification

A customer requesting only an initial evaluation generally does not need to provide government-issued identification solely to obtain a preliminary quote.

If the customer elects to proceed with a proposed sale or trade, EGA Guitars may require seller verification before completing the transaction.

Verification information may include:

  • Legal name

  • Current address

  • Telephone number

  • Date of birth

  • Government-issued photo identification

  • Identification number

  • Image or copy of identification

  • Signature

  • Ownership certification

  • Serial-number information

  • Other information reasonably necessary to verify the seller, property, or transaction

Payment or trade documentation may be required to match the verified seller's identity.

EGA Guitars may decline or pause a transaction if required verification cannot reasonably be completed.

15. Seller Ownership Certification

By proceeding with a sale or trade, you represent and warrant that:

  • You lawfully own the item or possess full legal authority to sell or transfer it.

  • The item is not stolen.

  • The item is not knowingly counterfeit.

  • The item is not rented, borrowed, or leased property.

  • The item is not subject to an undisclosed lien, security interest, ownership claim, or other restriction preventing transfer.

  • Serial numbers or other identifying information have not been knowingly altered, removed, concealed, or falsified for an improper purpose.

  • Material information you provide concerning the item's identity, condition, history, modifications, and ownership is accurate to the best of your knowledge.

  • You have legal authority and capacity to enter into the transaction.

16. Stolen, Counterfeit, or Suspicious Property

EGA Guitars does not knowingly purchase stolen, counterfeit, fraudulently obtained, or unlawfully possessed property.

EGA Guitars may suspend, investigate, or decline a transaction when reasonable concerns exist regarding:

  • Seller identity

  • Ownership

  • Authenticity

  • Serial numbers

  • Altered identifiers

  • Fraud

  • Theft

  • Counterfeiting

  • Transaction information

  • Other suspicious circumstances

EGA Guitars may cooperate with law enforcement, property-reporting services, manufacturers, or other authorized parties where reasonably appropriate or required.

If EGA Guitars is instructed or legally required to preserve, surrender, or refrain from returning property in connection with a theft, ownership, fraud, or law-enforcement matter, EGA Guitars may comply with that requirement.

17. LeadsOnline and Property Reporting

EGA Guitars may use LeadsOnline or similar authorized property-reporting services in connection with secondhand-property acquisitions.

EGA Guitars may submit applicable transaction information where legally required or voluntarily as part of our theft-prevention, fraud-prevention, ownership-verification, and property-recovery practices.

Reported information may include:

  • Seller name

  • Address

  • Telephone number

  • Date of birth

  • Government-issued identification information

  • Transaction information

  • Property description

  • Brand

  • Model

  • Serial number

  • Transaction amount

  • Photographs

  • Other relevant transaction information

By proceeding with a sale or trade, you acknowledge that applicable transaction information may be reported to LeadsOnline, law-enforcement agencies, stolen-property databases, or other authorized property-reporting services.

Use of such services does not necessarily mean that reporting is legally required for every transaction.

18. Internal Verification Hold

EGA Guitars may place acquired secondhand merchandise into an internal security or verification hold before offering the merchandise for resale.

A verification hold may provide additional time for potential ownership issues, serial-number issues, theft reports, fraud concerns, or transaction discrepancies to be identified.

Unless otherwise communicated or required because of a legitimate legal, ownership, fraud, payment, or security issue, an internal resale hold does not by itself delay payment after an acquisition has otherwise been finalized.

Any hold required by applicable law will control over EGA Guitars' internal procedures.

19. Sale and Trade Options

Where available, EGA Guitars may offer:

  • Payment for an outright purchase; or

  • Trade value toward eligible merchandise.

A cash purchase value and a trade value may differ.

Additional trade bonuses or promotional values may be offered and are governed by the applicable offer or promotion.

Trade credit may be subject to transaction-specific terms communicated before completion.

20. Payment

Payment or trade credit is issued only after:

  • EGA Guitars receives the item;

  • Physical inspection is completed;

  • A final offer is established;

  • The seller accepts the final offer;

  • Required seller verification is completed; and

  • Material ownership, authenticity, fraud, or transaction concerns have been reasonably resolved.

Available payment methods and expected payment timing will be communicated as part of the transaction.

EGA Guitars may reasonably delay completion or payment while investigating a legitimate ownership, identity, fraud, counterfeit, payment, or legal concern.

21. Shipping Damage and Loss

Customers must package gear carefully and follow applicable shipping instructions.

When an EGA-provided shipping arrangement is used and property is lost or damaged in transit despite reasonable compliance with EGA Guitars' packing requirements, EGA Guitars may investigate the shipment and pursue an applicable carrier or insurance claim.

The seller agrees to reasonably cooperate with requests for photographs, packaging information, documentation, or other information needed for a carrier or insurance claim.

When the seller independently arranges transportation, responsibility for loss or damage occurring before delivery to EGA Guitars may remain with the seller or the seller's carrier, subject to applicable law.

Nothing in this section transfers ownership of an item to EGA Guitars before completion of the transaction as described above.

22. Offer Expiration and Market Changes

Preliminary offers are based on market conditions and EGA Guitars' acquisition needs when issued.

An offer may include an expiration date.

If significant time passes before the seller proceeds, market conditions materially change, the condition of the item changes, or EGA Guitars' inventory needs change, EGA Guitars may re-evaluate the item before shipment or acquisition.

23. No Appraisal

An EGA Guitars purchase or trade offer is an offer to acquire merchandise for resale.

It is not:

  • An insurance appraisal

  • A tax appraisal

  • A formal valuation

  • A certification of authenticity

  • A representation of maximum potential market value

  • A guarantee of what the seller might receive in a private transaction

24. No Consignment Unless Separately Agreed

The Sell Your Gear program is intended for proposed purchases and trades by EGA Guitars.

Submission or delivery of property does not create a consignment relationship, bailment for sale, agency relationship, partnership, or joint venture unless EGA Guitars expressly agrees to a separate arrangement in writing.

25. Photographs, Personal Information, and Privacy

Personal information and photographs collected through Sell Your Gear are handled in accordance with the EGA Guitars Privacy Policy.

Sell Your Gear submission photographs are automatically deleted no later than 30 days after submission, subject to the circumstances described in the Privacy Policy.

Seller-verification information, transaction records, ownership certifications, property-reporting information, serial numbers, accounting records, payment records, shipping records, fraud-prevention records, or other information associated with an actual or proposed transaction may be retained longer where reasonably necessary for legitimate business, accounting, taxation, security, fraud-prevention, ownership-verification, property-reporting, dispute-resolution, or legal-compliance purposes.

Information submitted to LeadsOnline, law-enforcement agencies, payment providers, shipping providers, or other independent third parties may also be subject to those parties' own retention requirements.

26. Right to Decline Transactions

EGA Guitars may decline an acquisition based on reasonable business, legal, security, authenticity, condition, inventory, resale, or fraud-prevention considerations.

This may include:

  • Excessive repair requirements

  • Low resale demand

  • Inventory levels

  • Condition concerns

  • Authenticity concerns

  • Ownership concerns

  • Missing or altered serial numbers

  • Seller-verification issues

  • Material submission discrepancies

  • Prohibited property

  • Suspected fraud

  • Other reasonably relevant circumstances

EGA Guitars will not refuse a transaction for a reason prohibited by applicable law.

27. Unclaimed or Unresponsive Transactions

If EGA Guitars has received an item and the seller stops responding before the transaction is completed, EGA Guitars may make reasonable attempts to contact the seller using the contact information provided.

EGA Guitars may return the item to the seller's verified address and may require payment or reimbursement of reasonable return-shipping costs where appropriate and permitted by law.

An item does not automatically become the property of EGA Guitars merely because a seller fails to respond. Any treatment of genuinely abandoned or unclaimed property will be handled in accordance with applicable law.

28. Applicable Policies

These Sell Your Gear Terms should be read together with the:

  • EGA Guitars Privacy Policy

  • EGA Guitars Terms of Service

  • Applicable Shipping Policy

  • Other applicable EGA Guitars policies

The EGA Guitars Terms of Service, including its dispute-resolution, arbitration, class-action waiver, governing-law, limitation-of-liability, and other generally applicable provisions, applies to Sell Your Gear submissions and transactions to the extent applicable.

If these Sell Your Gear Terms conflict with a mandatory requirement of applicable law, applicable law controls to the extent of the conflict.

29. Electronic Acceptance and Records

Where EGA Guitars provides a checkbox, button, electronic signature, or other electronic method of accepting these Sell Your Gear Terms, your electronic acceptance constitutes your agreement to these terms to the extent permitted by applicable law.

EGA Guitars may maintain electronic records showing the version of the terms presented, date and time of acceptance, submission or transaction identifier, and other information reasonably necessary to document the transaction.

30. Changes to These Terms

EGA Guitars may update these Sell Your Gear Terms from time to time.

The version applicable to a transaction will generally be the version presented or made available when the applicable submission or transaction was initiated, except where a change is required by law or separately agreed.
